Patent Registration in Vietnam
Patent prosecution with IP Vietnam. As for trade marks, a foreign applicant without residence or a business establishment in Vietnam MUST file and prosecute through a licensed Vietnamese IP agent. An invention application is published in the 19th month from priority; a separate request for substantive examination must be filed (reported within 42 months of priority for an invention, 18 months for a utility solution). An invention patent runs 20 years from the filing date (a utility-solution patent 10 years), subject to annual maintenance fees. Fees follow Circular 263/2016/TT-BTC; the temporary 50% industrial-property fee reduction (Circular 64/2025/TT-BTC) applies through 31 December 2026.
