Patent Registration in Philippines
Philippine invention patent with IPOPHL — filing (which includes the first five claims), publication in the e-Gazette after 18 months, and a request for substantive examination that must be made within 6 months of publication, for a 20-year term from filing. Annuities are payable annually from the 5th year and rise over the term. Fees follow the small-entity / big-entity split (small entity = total assets of PHP 100,000,000 or less) and are inclusive of the 1% legal research fee. A foreign applicant without a Philippine establishment must appoint a resident agent.
