Trademark Registration in Mexico
Mexican national trade mark (marca) application with the IMPI. The study of a national application costs $2,695.18 MXN before IVA (Art. 14a of the IMPI tariff) and, because each Nice class is filed as a separate application, that fee is effectively charged per class; filing through the Marca en Línea system earns a 10% discount on it (Disposición Novena), and IVA is added to every tariff amount under Disposición Sexta. Registration runs for 10 years from the filing date and is renewable for successive 10-year periods at $2,597.77 per class (Art. 14c). Mexico also requires a declaración de uso of the mark — at the third year and on renewal — at $985.67 (Art. 14d), and studying a third-party opposition costs $3,704.09 (Art. 14b). Mexico is a Madrid Protocol party, so the country can alternatively be designated through WIPO, where the IMPI individual fee is paid in Swiss francs. A foreign applicant without a Mexican domicile customarily appoints a local representative and gives a domicilio para oír y recibir notificaciones in Mexico; whether local representation is strictly mandatory is in the LFPPI and was not confirmed.

The IMPI tariff expressly obliges 'personas físicas o morales, nacionales o extranjeras' to pay the fees; foreign applicants without a Mexican domicile customarily appoint a local representative. Whether a licensed local agent is strictly mandatory is set by the Ley Federal de Protección a la Propiedad Industrial, which was not fetched during research — confirmed at quote.
