Patent Registration in Cayman Islands
A Cayman patent is obtained ONLY by re-registering (extending) an already-GRANTED UK patent, or a European patent designating the UK (EP(UK)) — unlike trade marks, patents here remain a re-registration regime under the Patents Act. It cannot be based on a pending application, and the application to re-register must be made within five years of the date of grant of the underlying patent; only the UK / EP(UK) registration number is required, and a Cayman-registered agent ordinarily resident in the Islands must transact the filing. The re-registered Cayman patent runs in step with, and for the remaining term of, the underlying UK / EP(UK) patent. CIIPO's published fees for maintenance and renewal are KYD 200 each, with KYD 150 to change particulars, and the penalties for letting it lapse are severe: KYD 100 late payment, KYD 1,984 late renewal and KYD 2,568 re-activation. The initial recordal fee is the one number the official fee page did not yield, so it is quoted rather than guessed.
