Pollution Control Consent in West Bengal

Consent to Establish and Consent to Operate from the State Pollution Control Board in West Bengal. Governed by The Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, under which Consent to Establish and Consent to Operate are granted; the Environment (Protection) Act, 1986 and the Environment Impact Assessment Notification for prior Environmental Clearance. Applies where: All new intending projects, developmental and industrial, require Consent to Establish; there is no minimum size. Running units and units starting operation after establishing under an NOC must hold Consent to Operate. An 'exempted' category exists for which consent is not required. Prior Environmental Clearance is additionally required for the project types scheduled in the EIA Notification (the page notes 29 listed project types such as petrochemicals, oil refineries, cement, thermal power, bulk drugs, fertiliser, dyes and paper). Renewal: The Consent to Establish (NOC) is valid for 5 (five) years. Consent to Operate must be renewed periodically after expiry of the previous certificate; the fee is submitted at one time for seven years (Green), five years (Orange) or three years (Red).
