Fire NOC in Sikkim
The fire-safety no-objection certificate required before the premises may be occupied in Sikkim. Governed by The Sikkim Fire and Emergency Services Act, 2023 (Act No. 04 of 2023), gazetted as Gazette No. 226 on 5 July 2023, with the Sikkim Fire and Emergency Services Rules made under it (rules 28 to 31 and Schedules I to V). Applies where: Rule 28 lists the buildings that do NOT require a certificate from a Qualified Third Party Agency: residential (excluding hotels) below 15 m, or with a single basement of covered area under 500 sq m; educational below 15 m with floor area under 500 sq m; institutional (nursing homes, hospitals) below 15 m with plot area under 500 sq m; business (offices, banks, labs, libraries, data processing centres, IT parks) below 15 m with floor area under 500 sq m and a single basement under 500 sq m covered; mercantile (shops, markets, departmental stores) below 15 m with floor area under 500 sq m and a single basement under 500 sq m covered; and any occupancy where only fire extinguishers are required under the applicable codes. The Rules state expressly that this table is NOT exhaustive. The Act separately defines a multi-storied building as one of 15 metres or more. Renewal: Rule 30: a Provisional, Final or Renewal Fire Safety Certificate is valid for 5 YEARS for residential buildings other than hotels; 3 YEARS for non-residential buildings; and only 1 YEAR for hotels, hospitals, assembly, storage, industrial and all other occupancies, including any building requiring a certificate from a Qualified Third Party Agency. The State Government may reduce or increase the validity by general or special order, recording reasons. Renewal is applied for on the online portal in Form A-11.
