Patent Registration in India
Patent drafting, filing and prosecution with the Indian Patent Office. The First Schedule has two fee columns and the difference is large: a natural person, a startup, a small entity or an educational institution files Form 1 for Rs 1,600 on e-filing and requests examination on Form 18 for Rs 4,000, where every other applicant pays Rs 8,000 and Rs 20,000 — which is why we register a client for Udyam or DPIIT recognition before filing where they qualify. A complete specification must follow a provisional within 12 months with no further extension; the application publishes 18 months from filing or priority, with early publication available on Form 9; and since the Patents (Amendment) Rules 2024 the request for examination must be filed within 31 MONTHS of the priority or filing date, shortened from 48 — the single most expensive deadline to miss on this page. The first statement of objections must be answered, and the application put in order for grant, within three months, extendable month by month on Form 4. Pre-grant opposition is decided by the Controller within one month of notification or of the hearing, and a post-grant opposition may be brought within one year of publication of grant. The term is 20 years from the date of filing, maintained by renewals from the 3rd to the 20th year, and paying renewals in advance electronically for at least four years earns a 10 per cent reduction — a saving most sites do not mention. The statement of working on Form 27 is free and is now filed once every three financial years, within six months of the end of each three-year period, NOT annually. An applicant who neither resides nor has a place of business in India needs an address for service in India and in practice a registered Indian patent agent. IP India publishes no filing-to-grant service level, so we quote stages, never a date. For a DPIIT-recognised startup there is an 80 per cent rebate on filing fees, the Central Government bears the entire facilitator fee, and the application is fast-tracked.
