Patent Registration in Hong Kong
Hong Kong patent prosecution with the IPD. Since 19 December 2019 there are two routes to a standard patent with a maximum 20-year term: the ORIGINAL GRANT PATENT, filed and substantively examined directly in Hong Kong (Form OP1 request for grant at HK$345 e-filed, Form OP2 substantive examination at HK$4,000); and the RE-REGISTRATION route, based on a patent granted by a designated office (CNIPA, EPO(UK) or the UK IPO), via a request to record the designated application (Form P4, HK$275) followed by a request for registration and grant (Form P5, HK$275). Separately a SHORT-TERM PATENT is granted without substantive examination on Form P6 (HK$545 e-filed) for a maximum of eight years. A standard patent is renewed annually after the third year — HK$450 a year for years 4–10, HK$620 for years 11–15 and HK$850 for years 16–20. There is no small-entity fee concession. A foreign applicant needs an address for service in Hong Kong.

An address for service in Hong Kong
VERIFIED: the IPD requires an address in Hong Kong for service of documents. There is no requirement to use a registered patent agent specifically — an applicant may file themselves — but a foreign applicant with no Hong Kong address in practice appoints a local agent to provide it.

Route Chosen
We select the original-grant route (substantive examination in Hong Kong), the re-registration route from a CNIPA / EPO(UK) / UK IPO patent, or a short-term patent for an eight-year term without examination.
Application Filed
Form OP1 (HK$345 e-filed), Form P4 (HK$275) or Form P6 (HK$545) is filed with the Patents Registry with a Hong Kong address for service.
Examination or Recording
On the original-grant route substantive examination is requested on Form OP2 (HK$4,000) and objections are answered; on the re-registration route the designated application is recorded and registration and grant requested on Form P5.
Grant & Renewals
The patent is granted — up to 20 years for a standard patent, maintained by annual renewals from after the third year (HK$450 for years 4–10), or up to 8 years for a short-term patent with one renewal at HK$1,080.
