Patent Registration in Brazil
Brazilian national invention-patent prosecution with the INPI — electronic filing is R$260 (R$380 on paper, R$130 at the 50% reduced rate), the examination request covering up to ten claims is R$870, with per-claim fees above ten (R$140 for claims 11–15, R$290 for claims 16–30, R$740 for claims 31 and beyond, each halved at the reduced rate), and issue of the letters patent (expedição de carta-patente) is R$240 in the ordinary term. The invention-patent term is 20 years from filing (a utility model 15 years), maintained by anuidades from the third year: R$1,000 for years 3–6, R$1,600 for years 7–10, R$2,200 for years 11–15 and R$2,800 from year 16, each halved at the reduced rate; the pending application's earlier annuity is R$400. Examination must be requested within 36 months of filing or the application is shelved (LPI art. 33). An applicant domiciled abroad must act through an attorney domiciled in Brazil, and Brazil is a PCT contracting state, so the national phase is also available.
